Ebay Seller

If someone's selling 5 cars right now on ebay and more in the past on ebay from an industrial unit doesn't that make him a business seller even though he's not listed as one?
What do you think?

I'd think, after that, the onus would switch to prove they are not.

I suppose ebay have rules on this but he's doing nothing iillegal, he is essentially acting as a sole trader.

eBay's own guidelines define anyone who buys goods for the purpose of reselling them (as the car trader is clearly doing as a business seller:

HMRC will also most definitely view him as running a business!
