Mr Smith signs a letter from his employer admitting that Mr Smith's alcohol dependency is interfering with Mr Smith's job performance.
Mr Smith claims he signed the letter on the premise that his job was not under threat of termination.
However, Mr Smith's employer hands Mr Smith a letter of termination, of which Mr Smith refuses to sign.
Mr Smith now seeks legal redress.

I don't understand the situation. Is this a real life situation or one from a course of study? What is the basis of the termination- incapabilty? Has a process been followed of warnings and targets for improvement?
