I believe its illegal to install one with out the persons knowledge. So like most illegal activities, you won't announce your intentions to the world. If no one sees you doing it how will anyone know you did it, presuming they found out!
Yes I think it comes under section 1 of the computer misuse act:

1.(1) A person is guilty of an offence if
(a) he causes a computer to perform any function with intent to secure access to any program or data held in any computer;
....

(3) A person guilty of an offence under this section shall be liable on summary conviction to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale or to both.

OK well what I meant is, if I wanted to keep an eye on what someone was doing, without them knowing I was, would they be able to locate it on their own PC especially if said person knew what they were doing with computers? Oh, its not really worth it, is it?

My H had an affair last year (met her through an internet dating site for married people) when I was pregnant and although he ended it, said it was the biggest mistake of his life, that he loves us and swears he will never do it again, it had a devastating affect on me and I am still angry and still hurting a lot and just scared he will do it again.
Well as I said, it is actually quite a serious offence and although I think it's unlikely that charges would be brought in the context of a marital dispute it's really not advisable, you might find it awkward in a divorce case if it ended up there.

You really want to think about it carefully because if you start spying on him and he finds out you might kill the marriage for good.

I've lost count of the number of times I've seen posts on here where someone has been going through their other half's mobile phone and end up torturing themselves about whether or not to confront them over something.

Put the boot on the other foot and think about how you'd react - yeah I know you've reason etc. etc. but still.

For what it's worth I tend to think that whilst some people are serially unfaithfull there are a fair number people who stray once and never again - it's reckoned that 60% of men and 40% of women are unfaithful at one point in their lives.

Personally I think in most things once is a mistake, twice is a pattern

No, I think you're right. Its really, really not worth the hassle and the risks. Thanks :)
Did you not see on TV very recently a six year old child put a key logger on an MP's laptop so that they could track her details, by the way this was with the MP's consent and the child walked in past security guards without a problem.
I have done this dont worry about the legalities coz if your that concerned about what there typing or doing im pretty sure legally you have the moral high ground i have one running on my daughters pc so install it but make sure any spy zapping software is aware of it or it will block it from working they can run in stealth mode so no apart from spyware software it will be invisible
It is possible to install keystroke recorders hardware on computer. Better you may install VGA/DVI Screenshot Monitoring Hardware, which is the superlative of the hardware keylogger. This monitoring hardware cannot be detected by any anti-virus or any spy software.
