The CPS apparently don't think so, and in a case like this, they would have taken the opinion of senior counsel before deciding. The NMC hearing would not be proceeding if the CPS were prosecuting the medical staff for manslaughter.

This case would have to be brought on the basis, not of ordinary , civil, negligence, but "gross negligence". That would be why no prosecution for manslaughter has been brought.

I am....and have always been...a fairly easy going person albeit one who expects things to be done properly. My experiences with some of the doctors and nurses who treated my husband have made me feel a charge of manslaughter would be appropriate in some cases.

It's borderline, causing death by arrogance if there was such a crime, they do need some sort of kick up the jacksy, what appalling indifference to sufferring.

There certainly is a problem, imo. It seems to me that the people that shout the loudest get the best treatment. If that was my son I would have refused to take him home and would have kicked up a massive fuss.

@Ummmmm -thats what I thought too -about kicking up a fuss - I'm sure the mother did all she thought she could do -he was too ill to take him to another hospital I think. It breaks my heart everytime I read that story -i was unfortunate enough to have a stay in that hospital after a riding accident and it was terrible. Our neighbour went in there with a bad toe and they messed about so much he got gangrene and ended up having his leg amputated just under the knee.

Unlike most occupations, clinical medicine is not an exact science.......the human body an psyche makes sure of that.

There is no law against against wrong or misdiagnosis, it happens everyday in every hospital and if there had been a law, then the prisons would be full of convicted doctors.
All doctors in Clinical medicine ay some time in their professional career have made errors in their diagnosis, some minor and others,as in this case, tragic and fatal.

FredPuli is correct, one would need to show and prove negligence in the misdiagnosis of this case and call into competence or lack of it, that of a doctor or nurse who's qualifications and expertise should have acted differently.

I do indeed feel true sorrow for the victims in this case, but also the medical and nursing staff will also feel devastated.

Zacs -I'll pose my questions in whatever tone I want. You interpreted the question as ' Shouldn't these nurses...?.( as in -OP has already decided and wants you to agree) when I meant' Should these nurses' ? (as in discuss this and see what conclusions we come to) . Grown up debate rather than one line posts derating the OP and adding nothing of interest to the thread.

yes sqad but how do you account for the appalling arrogance of many in the medical profession. "My diagnosis is correct, you're being neurotic and are an ignorant pleb, don't even challenge my opinion". It's not just this story, I have experienced it personally.

Doctors and nurses are but human beings firstly and subjected to human failings such as moments of arrogance, sarcasm and ill tempered patient management.

Being arrogant is not a cause for legal action..........negligence is.

While I agree with Sqad that Doctors and nurses are only human I'm afraid that from a personal level if any child of mine was in pain and was ignored like that the person concerned would probably find themselves on their back discovering what a painful nose felt like.

no sqad that's not the dialogue, that's the unspoken sub text. That's my words put to the displayed attiude. I was painting a more general picture and the quoted text I used is just how it would come across in words.
