Employer creating new job.

Can a employer create a new job, and then approach an employee who they think is suitable for that job, basically giving that employee the impression that the job is theirs if they want it. With out advertising the job internally for other employees to apply for ? I have been looking at the Equal Rights act, and can't find anything in there.

I believe they can unless they have a union agreement that all positions must be advertised internally. So it depends on your company having union representation.
Legally they can but often this sort of thing comes under internal company rules that for example it must be adverstised generally in the company.
