Annual leave/ shift changes......

I get 25 days holidays a year and back in May I booked off some leave for a holiday in August, 3 of which were Annual Leave and 4 were rest days.

I had also booked off a few days later in the year and 4 days off in December which left me with no more Annual leave.

In July my company changed my shifts around which made my August rest days as working days.

I was told that I could swap my later Annual leave days to avoid taking the August days as Unpaid Leave or keep them and lose 4 days pay which I did.

Surely this is not right as if I had used my later Annual Leave days to cover my 4 rest days, come the time in December when I wanted the days off I would`ve had to work them and lost out?

Hope this makes sense

Elvis,

You have done my head in reading your post :-)

trt, it does make sense if you got the payslip I did this week!
If I've read your post correctly, you had seven days off in August, but did you take them as paid leave, in which case you wouldn't have the four days available to take in December, or did you take three days paid and the other four days unpaid, which enables you to take the four days off later in the year?

Surely, in total you will still have had 25 days paid leave over the course of the year.

twix, I had 7 days booked off in August, 3 were annual leave and 4 were rest days as when I booked them before July.
But they changed my shifts and the 4 rest days then became working days.

I`d already booked my 4 days off for December but they are saying I should`ve cancelled the December dates to cover the August dates
Did the shift change cause any of the 3 days booked as leave to become rest days?
Question Author
No, the 3 days booked would still have been working days
If you took the 7 days off in August as paid leave you obviously don't still have the 4 days available to take off in December unless you take them as unpaid.

Although your shifts were changed, you can't expect your employers to give you an extra 4 days paid leave!

twix, only 3 days in August were paid leave, the other 4 days were rest days until they changed the shifts, which then made them unpaid leave

why should I lose out because of shift arrangements?
ELVIS are you you in a union? if you are they should be able to sort it out for you.
As I see it, you booked 11 days off between August and December, seven were annual leave and four rest days. Following the shift change, those seven annual leave days now come in the one period and if you take the four days off in December still, you will on be paid for them. You have not lost out
Unlike the rest of the crowd above, I understand exactly what you mean - you fixed your holiday around the dates of your shift pattern to minimise the number of days holiday you would have to take - now because the company has changed the pattern you end up having to take more days holiday.
I think you have a reasonable case since it is employer who changed the terms and when I have been faced with this before in industry I have accepted the employee's side. I suggest you make your case to HR / personnel.

Suggesting that you go to a union is a futile response - that's what people come on here to get answers - otherwise the stock answer to every question gets really easy. The answer to questions in 'law' section is 'see a lawyer', the answer to questions in 'food and drink' is 'speak to a chef', and so on. Pathetic.
You can always ask ACAS, they are very helpful on employment matters http://www.acas.org.u...x.aspx?articleid=2042
buildersmate, as I am one of "the crowd" how many days had Elvis booked as annual leave previously and how many has he had to book now? I seem to be missing the point...
Agree with buildersmate - if you've booked the annual leave next to the rest days and then the rest days are moved you now have a severely messed up holiday. Unless the company specify that rest days are subject to change up until a certain time I sggest you go back to them andrequest they are reinstated them as you have booked and paid for a holiday in all good faith.
would they not let you work some of your rest days to compensate for the days extra 4 days taken in August, or make a private arrangement with a colleague to swap rest days.

Sorry for the delay in answering... buildersmate has hit the nail on the head (scuse the pun)

My week off consisted of 3 annual leave days and 4 rest days, had that stood I would`ve been paid for a full week as annual leave and rest days are paid for.

But when they changed my roster and the 4 rest days then became working days I had to take those 4 days as unpaid leave which has left me 4 days without pay.

I`ve been in touch with HR and hopefully they will sort it out
