My daughter is renting a 3 bed house in london brent area, her housign benefit gets paid into her landlords account? I have 3 bed house i wish to lease it out to a housing assoication to house homless families etc in return for rent. Can my daughter apply to the council and move into that house??

You can ask the HA if they are interested but it will then be for them to decide who will be offered the tenancy.  Three bed houses are normally classed as 5 person homes in HA terms and if your daughter has a family of 5 then she will be considered.  However, be prepared that there may well be needier families than hers.

You can rent the house to your daughter but the chances are you will have to go some extreme lengths to prove your daughter is paying you the full and fair rent that she is claiming for.  I know of some councils who will not pay benefits on a home which is owned by a relative but i am not sure of the law on this.  I would firstly investigate letting the house privately to your daughter by speaking with the benefits people at the council.

If you have previously let the property out to un-related tenants, then your daughter can move into the house and the council should pay her rent to you despite your relationship.

However if you have never let the property out previously, then the tenancy created may be deemed as 'contrived' by the council and they won't pay you.
