Renting a room from an ex.

Hi,

To cut a long story short.

I own my house. My ex rents hers, and claims benefits t opay the rent. Can I rent a room from her. Or live there rent free while letting my house out.

We are no longer together, but I wonder where we stand legally in the financial sense?

IMO either course of action would adversely affect her benefits
she would have to declare another adult in the house, which would definitely affect her Council Tax benefit, and perhaps her Housing benefit. she would have to declare your rental income which would affect any benefits she receives.

if you claim any benefits you would have to declare your rental income to where ever your benefits come from, and they would most likely be reduced or cease altogether. you would have to declare that you are renting your property to your mortgage lender (unless you own outright).
also, the exes LL is the only one who can rent out rooms - your ex can't "sublet"
Some years back when my BF moved in with me, the council found out like a shot a removed my 25% single person council tax rebate.
