Do we have to advertise a job?

Does a company have to advertise a job? It is a non-profit company and not a public company. We have a vacancy we would like to fill and a volunteer is doing the job currently. Can we just employ her without having to go to the expense of advertising and recruiting? ES

oh, right, that's what I thought. I suppose ideally a question shouldn't say 'do I have to do this or do I have to do that?'

Thanks for that, people keep saying we should advertise because we are seen to be an equal opps employer but she is perfect for the job and has proved it by working as a volunteer so we do not want to go through the advertising process at an expense we haven't got. Thanks for that. ES

You have the perfect candidate...no need to advertise. Most of the jobs I've had haven't been advertised.

I was just offered my job, wasn't even looking for one at the time, i was going to wait til my youngest started full time school.

Legally you can just appoint her. It is good practice though, I suggest, to advertise the role internally and allow her to apply if you think there are others in the organisation who could be considered or would be upset if they weren't able to apply.
