Shared Freehold - Structural survey / Repair costs

HI,

We own the ground floor flat in a converted house. We have a shared freehold with the people who own the flat above us.

I know that we are jointly responsible for many repair costs of common areas eg the roof.

My question is that if the flat above is now showing some structural issues (Cracks around the place, doors not closing properly etc) and our ground floor flat is not, are we jointly responsible for the cost of getting a surveyor in and the subsequent repairs to their flat?

Any advice would be greatly appreciated. Thanks.

I believe that the freeholders are jointly reponsible for all building maintianence. Would you want all the financial responsibility if the ground floor were showing signs of damage like this?

Regardless as to wether your flat is showing signs of stress if the top one falls down so does yours!!!

However it would also depend on the wording in the joint freehold.
