I started with current employer feb last year and i was given a 6 month probationary contract and the contract states that after the 6 month period i would be given a review and it also states that 1 week is required for notice. When asked at interviews how much notice I have to give do i go by whats in the contract that i have or do I have to go by what would be stated in the permanent contract.

The 6-months probationary contract didn't mean that you were on 6-months notice of termination (by either side) - only that the probationary period lasted for 6 months.
You are probably on one week's notice, if that is what the documentation says.

Yes i understand that the 6 months probation didnt mean i was on a 6 months notice of termination, if it did then i would have been out of there like a shot
Not sure I follow this. If you started on a temporary contract in Feb 09 then clearly that has long since expired and you should be on a permanent contract. Are you saying none has ever been issued?

I take it you are saying that a permanent contract would require more than one week's notice but your temporary one doesn't? That being the case I would presume that you are deemed permanent but buildersmate would know better.
