Well following the question Takeaway, I thought this question was most appropriate.

Had it have been 1st April I would have ignored this story, but it is too laughable to be missed.

/// His furious family is now considering legal action.///

Hadn't they notice that McDonald's print a warning on their drinking vessels, that hot liquids could scold, (or words to that effect)

Who is to blame?

Ben Lewis for going to McDonald's in the first place?
The assistant for not checking the temperature of the tea?
The assistant for not putting the lid on tight?
McDonald's for putting in a speed bump?
or his girlfriend for driving the car too fast over the bump?

Tricky one this, shall we turn it over to the judge/

"'It's so dangerous, it could have been a baby or a young child that was burnt, and that would have been so much worse."

thats so true, i always get my baby to hold the hot drinks containers on her lap.

Its an accident, why oh why did he have the drink above his lap?
Yes the old McDonalds coffee one

It's a great example of frivolous legislation - until you look at things the newspapers didn't report

Like the fact that she spent 8 days in hospital and needed skin grafts and medical treatment for 2 years after

I notice that the mail also quotes the headline figure for the damages in the McDonalds case and doesn't bother it's readers with the fact that the compensation was cut on apeal from $2.9 Million by over 80%.

Now if I can find that in under a minute - why can't the Mail journalists?
Burns are always 'horrific'. Do you reckon he just got a bit of a scold?

I want a fancy yellow straw like the one in the photo.
Yes, the injuries are terrible but doesnt change the facts regardless of whether it was a slight scald or serious burns; surely a 17 year old can be expected to handle a cup of tea without emptying the contents over his lap? Gross stupidity/clumsiness is not McDonalds responsibility.
Of course it is boold. It's against the law for you to take responsibility for anything nowadays. Especially when it's so easy to make a living by screwing over others.

Now if you'll excuse me, I'm gonna sue the makers of the door I stubbed my toe on this morning.

On a more realistic note, and to echo others; the bloke must be a tool of the highest order if he cannot control a cup of tea, at 5mph, whilst THE PASSENGER in a car.
I burnt myself quite badly on the arm last year. I burnt it from the steam in the kettle. I might sue Breville...
you should, ummmm, and also sue the waterboard for allowing their water to boil at such a temperature.

why does no-one nowadays accept that accidents happen? why is someone else always to blame?
Got any numbers of no win no fees?
I've not clicked the link but surely this is an ancient story ? I recall discussing the suing of McDonalds over a hot beverage on a Net forum many years ago. You sure it isn't just a 'wind up' ?

The answer is of course that tea is made by brewing leaves at 100° C, so any purchaser should know that barring a slight cooling due to cup & milk, that is the temperature it is sold at. To warn of it isn't a sin, but does smack of nannying grown adults and should not be necessary. The owner (i.e. buyer) should take the necessary precautions.

It also means that, because the inmates took over the asylum many years ago, I'm sure it is legally all the seller's fault for just being there.

Perhaps they couldn't be ars*d, it is totally irrelevant to the main story, did you expect them to print the whole of the appeal court's transcript?

But if anyone else is interested apart from jake here is the full story of the case, "yawn".

But don't let that stop you from continuing to "let off steam" (pardon the pun) at the Daily Mail jake, because just like me, I am sure they are not bothered in the least.
