Hi
I am in the process of trying to claim back 200 in bank charges from this year for my Husband.
The bank replied to our letter and I stated we were in financial difficulty and needed refunding asap rather than being put on hold awaiting the high court decision.
They have asked to see earnings and outgoings etc - though we are a bit of an exception case as he is self employed so not straight forward.
My question is - one of their letters refers to a department that our case can be referred to which could affect our credit file if it does get referred.. sorry I cant remember the name of the department and the letter is at home!
If I am claiming financial hardship and want our fees back from Abbey - can it affect our credit rating? Will it be noted anywhere that other creditors can see?

Of course it will affect your credit rating. Who will want to lend to you after you try to claim money back from your original bank?

well will they post something on our file? With Experian?
Why should they - the bank charges have been deemed UNFAIR - so why am I to blame for trying to claw them back?

can anyone help me with an answer?
It won't affect your credit file... I reclaimed mine a couple of years back with no effect to my credit rating at all.

thank you cheekychops - how much did you manage to get back (if you dont mind me asking) and was it quite easy - or did you have to fight for it?
Hi nosha, I thought someone would have answered you by not. As far as I can tell all the bank have done is stated that your case 'could ' be referred to this department but it has not yet been referred. Its difficult to answer without knowing all the facts but if you have fallen into difficulty repaying loans or fall into arrears then this could affect your rating.

However you state that you are claiming back bank charges and I dont see how this would affect your rating. The fact that you are claiming financial hardship appears to be between yourselves and the Abbey and I think it unlikely that your credit rating would be damaged.

Hopefully someone will post a fuller explanation or perhaps you could post back the department they mentioned tomorrow.

yeah you could be right danchip! thanks!
I claimed bacy 820 and was surprised how easily they gave it back, I was expecting to have to fight for it and I didn't. Mind you, this was about 2 months before the court case came about and claims were put on hold :-)
