Gate onto another road

House in a cul-de-sac has put an access gate in the fence into another road oh where their fence runs down. to have easy acces instead of walking round the block. Is this legal as they do not live on that road. ?

oK.fine.... This bloke nx door is a bit of a dcik.... and I all I need to know is it law to do this...So when he should at me again for putting a tack in the fence for my chocloate creeper to grow up i have some ammo,.
There would be no requirement to have a fence at all so I don't see why a gate in the fence should be aproblem

Is it his fence? If so, he can put gates in it wherever he likes.

When you put nails into the fence, is it your fence or his? If it is his, he can stop you doing it, if it is yours he can't.

seems like I maybe should have asked 1st then...but it was only 4 tacks for some wire for a creeper. ooops

Unless he is using this to access by a vehicle, he is perfectly at liberty to do this. If he wants a vehicle access he has to request for Planning Permission (because Highways will want to establish that the vehicle access is not dangerous).
