The Data chap says not - the PNC (police national computer) - subject access search came back with nothing). the local station said there's something there 'says cautions - no further info as its archived'.

Datachap said ALL records are archived for 100 yrs. So if records don't appear on crb checks its because after 5yrs/7yrs/10yrs they're weeded out and can only be used for police-related jobbies.

I'm worried though in case some bright spark at local station decides to give this caution info to the CRB checking types and ends up (inadvertently) on my form.

NOW if that happens I know I can take matters further via info commissionar - data protection act - to have this removed - when it shouldn't appear.

HAS THIS EVER HAPPEND TO ANYONE OUT THERE?
A) They've had a caution oer 10 yrs old and its not appeared and B) has appeared
Can you tell me your experiences OR am I like the datachap said worrying unecessarilly?
(I bank monies for work and a theft caution wouldn't look good - but i have worked in this job nearly 5 yrs - merged with local centre 2 yrs ago - just done check now)..
All replies appreciated. BE

Police forces have a discretionary power to remove details of a caution from the Police National Computer after 5 years but there's no obligation upon them to do so. Therefore, you have no rights, under the Data Protection Act, to complain if such information appears on a CRB check.

CRB checks (both Standard and Enhanced) are only available where the Exceptions Order, under the Rehabilitation of Offenders Act applies. (Generally, that means where the employee, or volunteer, will have close contact with children or vulnerable adults). A caution for theft (from many years ago) would be unlikely to 'set alarm bells ringing' with an employer, unless (for example) the employee had access to valuable items belonging to the elderly and confused residents of a care home.

Thanks Buenchico.

I'll see what happens - I've been told if its over 10 yrs old then it shouldn't be shown on a crb form because its not assault/abuse against children/vunerable adults.

Its not on the PNC - its was the local station where it came up under archive.

Just checked online tracking its at the local station station will be returned soon - see what the outcome is.

Hi BriteEyes,

I would be interested to learn the outcome of this as I am in a similar situation myself at present, very very worried about whether a 19 year old police caution will show up on a CRB Standard Disclosure check! Would be grateful if you could let me know what happened in your case.
Thanks
