Fence replaced

A council company have replaced the fence to the rear of my garden. My property is privately owned and not a council property, although some houses in the street are. I returned home from work to find my fence had been replaced. Not only had I not requested this, I had no notification that it would take place - complete surpirse! The fence is a dark wook (poor quality) and what is more, only last year I spent over �300 erecting a high quality light wood fence. Upon questioning the council workers they simply informed me it was on their job list (which I have seen) and therfore carrying out their jobs. The manager has been unavailable all day and I just want advice on what if any recourse I have!|

Does a council owned property back on to yours - a shared boundary?

If so, are you sure you own the fence? What does it say on your deeds?

The deeds show it is my boundary (denoted by a T) and my garden backs onto a small road leading to a small housing estate (5 houses). Thanks for answering, I am getting no where with the council just passed round different departments.
I would seriously consider court proceedings to recover the cost of restoring the fence to the state it was before the council removed it.


You can do this quite easily in the Small Claims Court and it can all be done online.

In the first instance, write to the Chief Exec of your Council (or appropriate senior official) telling them you want your fence restored..... give them 14 days to reply. If you don't get satisfaction, write again, head it 'Notice of Intent' and tell them you will be issuing a summons if they do not comply with your request.

In the meantime - your local paper will love this story. And tell your MP as well.
