I am icurrently in dispute with my ex partner who is trying to register a charge on MY property. I bought it off him 2 yrs a go for the amount he wanted (all in writing). But he has now decided he wants more.... It is with the land registry at the moment. Can I remortgage this property whilst this is ongoing.

Once the charge is in place (any lawyer worth their salt can get this done very easily and very quickly) then you will not be able to remortgage.
did you involve solicitors when you bought his share of the house? If not, you need to take whatever it is you have in writing to your solicitor asap.

If solicitors were involved and the purchase was done legally, then there is no way he can turn round two years later and try to ask for more!! Surely his name will have been removed from the mortgage and the title and he has no further claim to the porperty.

Thanks for your reply morbidstorm. yes I had a solicitor and everything was done legally, it was him who declined legal advise (altho my solicitor wrote to him and advised him to get independant legal advise - he chose not to). My solicitor is fighting my case with the LR at the moment. It is now with the Ajudicator. This has been going on for over 14months - will it ever end???

The property was originally in his name only. After 5 yrs the relationship broke down.He then agreed to sell it me for less than the current value (he gave it me in writing and is now saying that I forged the letter!!) I redeemed him of his mortgage and I took out a mortgage in my sole name and the property was then registered to me.
