Wakefield by election delayed possibly indefinitely

The Conservative MP for Wakefield convicted of molesting a child was expelled by his party last month. It was assumed a by election would be triggered. He is now refusing to resign the seat which means a by election cannot be called.

If he was convicted of child molestation, wouldn't he be in prison?
The Observer reports that Khan has to write to the Treasury to set the resignation process going. He hasn't done so yet.
I thought convicted criminals were disqualified from holding a seat in parliament, in which case it isn’t his choice. Something odd going on here.
If he is sentenced to more than a year, there will have to be a by-election.
Think there's a legal difference between standing for parliament as a convicted criminal and retaining one's seat when convicted of an offence.

he's not been sentenced yet, so no.
But if his conviction disqualifies him surely that means he doesn’t have the option to resign - he’s just booted out?

He has been found guilty, but he hasn’t been sentenced. No date for sentencing has been announced.
Only if his sentence involves prison time is he automatically disqualified. If he avoids going to prison, he doesn’t have to resign and he can stay on until 2024.
He seems to be waiting and seeing.

He has been found guilty, no matter what the sentence I consider him scum and if he had an ounce of decency he would surrender his seat.

er, not any more. he was expelled from the party, and the HoC website today lists him as "independent".
If he was to brazen it out as an independent until the next election he would make near 200K in wages and expenses.
He'll not be in a hurry to go.
