Does he have to be touching the grass? So if he's in touch, he could jump, and all the time he's in the air with the ball in play, he can touch down (if he can do that before landing)

I'm sure there's a more straight forward answer.

the player is actually in touch, not hovering or any sort of trickery.

no it's not a penalty try, it's a normal try in the normal run of play.
By grounding the ball while not carrying the ball.

I only know it because it happened in a game I was in and we were adamant that the guy was in touch and the ref gave it and we had to wait until after the game for his explanation!
