if you make someone aware that they are infringing copyright like for instance a big retail outlet that has photo service with a disclaimer.. can they hide behind there disclaimer if you catch red handed someone infringing your copyright and then ask the retail outlet not to carry out the transaction because you can provide proof that you are the original copyright holder ..im of the understanding that if you make the secondary infringee i.e big retail outlet aware that an illegal action is taking place there disclaimer is void because they are now knowingly aware and are acting with knowledge

i am sorry if you found my question rather confusing but it is quite simple, i being the copyright holder, caught someone copying my images on a self service touch screen point of sales machine, in a very big multi national retail emporium "no prizes for guessing" the person copying my images "mrs x" placed the order and entered into a transaction with the big mnre i intervened and protested to the big mnre that i was the rightfull copyright originator and holder
