I always ask, if its not obvious from the menu.
If I had a severe food allergy, I think I’d be too frightened to eat out or have takeaways.
As long as a catering business labels the ingredients of their food, or makes customers aware, or ask customers if they have any allergies, then I wouldn’t think they could be held responsible.
It's a two way street really, outlets have a responsibility and we each have our own decisions to make.

You had some good replies last time but didn't return to discuss them.
Surely it should/must depend on whether you are forthright and honest about your products. If warned of an issue yet still serve what will cause it, then you should be held responsible. You were warned and didn't act. But if the customer just assumes a dish, without ingredients noted, will be ok and it's not, that must surely be their responsibility.
I think if I was a small food business, I would go one of two ways. I would either go niche and totally exclude the common allergens from my premises or I would be clear that anything I produce may contain the common allergens. But yes I do think that if you lie or if you are not completely clear about ingredients and allergen contamination then you are responsible.
If I had a serious food allergy. I wouldn't eat out or eat takeaways. You make it sound as if there are only two options; why not cook for yourself, if you are worried about dying if you eat the wrong food?
