If you owe 1 or 2 months rent to a landlord, is he within his rights to tell you he won’t do any repairs till the debt is cleared.

Yes, pay your rent!
he is within his rights to expel you...pay your rent !
well two completely moronic answers -
but this is AB !
No please do not delete - I think it is instructive for walk-ins to see the er varying quality of 'advice' given in good faith .... foo!

No he is not (LL)
yes T must give access - I think you should write rather than speak as there will be endless dispute in front of a judge

the two are distinct - if the tenant is 8 months in arrears I would make it quite clear the LL will seek eviction on ground 8 - and then I would probably do so ( no rent see?)

yes I am a LL and yes I have had this situation

watch nasty neighbours awful tenants and even worse Landlords
act early ! or regret it
Is this a private landlord or a council or housing association landlord?
You must your rent. Have a look at the Shelter website.

oh come on !
a LL has to do repairs ( as a duty)
and it is not connected with the duty to pay rent ....

or else everyone would take the roof off from non paying tenants
g
but if you or he is two months in arrears LL can get T out under ground 8 and I would quite honestly as LL

this is NOT "with holding rent because repairs are not done"
90% of these contracts end in eviction anyway

PP, why do you even use this site. You do nothing but put it down?
I'm pretty sure he's right, though, ummmm, the requirement of one to pay rent is unconnected to the requirement of the other to keep the place habitable. The landlord could give the tenant notice but he still has to fix the place, so I think the answer is No.
Yes, the landlord is within his rights to give notice (especially if you are two months late!), but not to withhold repairs.
doesn't this all go back to Peter Rachman who used to harass sitting tenanats until they left his properties?

The tenants do to no fault of their own Well yes and no. Wages going into bank failed to cover the due date of the rent for some reason. Landlord informed them of the arrears 6 months after they were due??? Doth are working with very low wages, and are trying to pay additional monies on top per month to clear the debt. Always a story behind everything ummmm & MM
What repairs need doing? Is it wear & tear ?
They are seprerate issues. If there is an agreement in place to clear the debt then the LL position is even weaker.
As ladybirder says Shelter is the best plce for advice.
// PP, why do you even use this site. You do nothing but put it down?//

because it is the Law thread and not the out-Law thread or off the wall thread or tell the lazy bustards to pay their rent thread

and secondly because I am a landlord and have had experience of rent arrears, eviction on ground 8 , and lack of repairs in arrears, and with-holding rent - doesnt this show? perhaps not.

I have had leaving tenants asking me to read their new leases and tell them what it means

now umm why do YOU use this thread - you never say anything new or of interest.
// Always a story behind everything ummmm & MM//

the tenants should contact the landlord
explain what is going on and try to come to some sort of pay-off agreement which is difficult because it will be more than their rent / m ( wh they struggle to pay)
