the following statement is one regularly heard when judges in murder trials set out their sentencing remarks:-

I must now sentence you for murder. As to this there is only one sentence recognised by law, which is one of life imprisonment. I must also set the minimum term which you must serve before you are eligible to apply to the Parole Board for release. I should make clear that the minimum term that I will set is the actual number of years that you will serve in prison before you may apply to the Parole Board. It will then be up to the Board to decide whether and when to release you.
Naomi - // I can't even imagine how one human being can do something like that to another. //

I have said on here many many times, that attempting to use rational intelligent thought and reasoning to understand base and inhuman behaviour is fruitless, and only makes you feel depressed.

There is no rational explanation, because it is not done from a position of intellect and reason, it is done from an animal savagery and a desire to hurt and to maim, without thought for the victim and the consequences.

I dread to think that anyone in the medical profession will seek 'reasons' when the perpetrator(s) is/are caught, but I suspect it will probably happen.

That does not mean that I don't wish to see a fair trial, and due legal process followed, but as a society, we must ensure that the creeping tendency for the 'rights' of the perpetrator to trump those of the victim, does not become the norm.
Exactly Mushroom. It's nonsensical. If that second sentence just read as follows...

As to this there is only one sentence recognised by law which is one of imprisonment, the minimum term for which I must now set.

...It would at least make sense. Then we could move on from arguing about whether life should mean life, and just argue about whether prison sentences for murder should be longer.
….all stemming from the fact that automatic eligibility for consideration for release occurs at the half-way point. a life sentence is indeterminate, and half of indertermination is indetermination. thus the judge has to set a minimum term in lieu.
I agree with Ludwig. A minimum term is a minimum term but 'Life' should mean exactly that - life. Anything else is a nonsense.
Alas this is a Murder trial for sure. The victim has succumbed to those horrific ,barberous injuries and is deceased.
