Hi legal types, I have what should be a simple question: Is TVLicensing a 'trader' and subject to The Unfair Trading Regulations 2008?
TVLicensing is a trading name of the BBC and operated by Capita Business Services Limited.
Simple, yet complicated.
Thanks!

“trader” means any person who in relation to a commercial practice is acting for purposes relating to his business, and anyone acting in the name of or on behalf of a trader.
[Section 2(1), Consumer Protection from Unfair Trading Regulations 2008]

Since the BBC isn't carrying out a 'commercial practice' by collecting licence fees, but merely enforcing the law, I doubt that a court would rule that it, or its agent, is covered by the Regulations.
