2 months ago i bought a pair of jean shorts 30.99 plus 6.99 postage total £38. they arrived 4 weeks later, no button holes on them, clip fasteners missing and totally different colour to the photos advertised, i mailed the chinese seller and requested return label, they told me they were unable to send return label from china. ok so meanwhile i went on holiday for a month, when returned i sent the shorts back via 1st class air mail on 2-dec. yesterday i asked ebay to move in and escalate this case as i was now £48 out of pocket for a pair of 3/4 length denim shorts. i phoned them i showed them the photos of the shorts, i showed them the photo of my return reciept and the photo of the package addressed to the seller. ebay asked me why i did not use tracked service i stated that 1st classed tracked was around £18 and roo expensive.... i got an email last night . ebay has made a final decision and made it in favour of seller. it also removed my negitive feedback against the seller .....

SHOCKED...and absolutely bloody discusted. i swear never ever again !!! ive been buying off ebay now approx 5 years with over 200 buys and an excellent 100% record.

Unsurprised. In my experience dealing with sellers from China has risk, and eBay sides with the crooks.

im fuming, all night i was unable to sleep thinking about why they would make such a decision ....i have come to the conclusion that they will want to keep the wholesale sellers onboard as it generates more income for ebay.

thats the only logical thing i can think of. unbloody believable.
I think ebay is easy pickings for fraudsters but in your case I think there is no certainty that the parcel ever arrived - that's why unfortunately a tracked service is needed.

yes, maybe my own fault for not using a tracked service . royal mail will at least give me back £20 i think for the missing parcel if these lying chinese sellers still say they have not recieved parcel.
You have no evidence that the parcel was received by the Chinese and they're lying by saying it wasn't.
Supposing you had never received it in the first place; would you have expected them to send you another one? Could they not just think that you were lying to try to get an extra one free?
DD, ebay has quite clear instructions on what to do if you not satisfied with a purchase. In this instance their instructions are to first contact the seller, then to open an incident report with ebay, then wait further instructions. Because you sent the goods back in the way you did, ebay has no evidence that you have done the right thing, even though you have.
However, you can open a claim with the post office or whichever courier you used, and you should get the money back that way.
eBay is very specific , tracked postage MUST be used for the return. If the items were defective ( rather than you just changed your mind,) then the seller has to refund return postage as well. You did not follow the rules so you lost.
I have bought quite a bit from China and India on ebay and never had a problem.On one occasion something didn’t arrive and I messaged the seller who sent another one.
You really should know by now to follow eBay's procedure, Diesel. If you had done so you'd have got all your money back.

to you BHG if i was unscroupuless or lying then do you think i would be posting this on AB dont be so bloody stupid.

as i say ive all the proof of asking for return labels etc, contact with seller etc, proof of return postage and photos of package with proper address.

just beware of buying from china, i have in the past bought a few things some of which were absolute crap ,maybe £10 or £15 spend and i wanted to send tthem items back but just didnt see the point so i never did , i allways promised myself i would learn my lesson but now i have.

dont buy from china or hongkong. infact im going back to the high street more often.
No need to have a go bhg - s/he is correct in why eBay refused to refund you. You have proof of posting, not proof that the seller received it - and that is why eBay found against you.

ok im wrong flaming you like that,i was too rash and didnt think things through. sorry but i thought you were accusing me of lying.

anyway. story over, enough said, think you all get the point.

will say one thing before i leave this topic and that is that i dont think ebay make everything clear, the site i think is very difficult even for me now after 5 years to navigate regarding returns and money back guarantees etc.

No problem Diesel dick, I wasn't getting at you. I was merely pointing out to you that the people at the other end don't know you from Adam and there are people in this world who would pretend they had sent something back when they hadn't. (the same people who buy a garment from M&S, wear it over the weekend and then return it for a full refund perhaps).
