Is burning rubbish in your back garden illegal?
For the past few week-ends, one of my neighbours has had thick black smoke coming from his back garden, which has meant his close neighbours have had to bring washing in, close windows etc.
One of them is thinking of reporting him to our Housing Association, but I wondered if there is anything they could do about it if it isn't illegal.

Thick black smoke would indicate rubber I’d imagine Barsel and I believe there’s a time scale for burning garden waste anyway

If it is constant thick black smoke, it could be a statutory nuisance. The people to report it to are environmental health.

I think what they are burning MIGHT be illegal - rubber & plastics need to be disposed of properly.

On the other side of his garden fence runs a main road (buses etc) which is only a small distance away.
It is believed he has a lot of rubbish in his garden and inside his bungalow and we can't understand why he doesn't just hire a skip to take it away.
Have read your link Bobbs and I would say his close neighbours could complain to the Housing Association or the Environment Dept at the council.

Skips cost quite a bit if you think you can burn it for free!

I'm sure it is Bobbs, it could be anything.
We think he's a hoarder as he very rarely puts any of his bins out for collection and his curtains are permanently closed so no-one can see in.
One of the neighbours has seen into his back garden when she has gone past sitting upstairs on the double decker bus and she said it's like Steptoe's back yard.

I think it is illegal after 8pm. Or at least it was in Cambridgeshire.
You need to look at your local Council's website to see what the rules are in your area.

When someone is creating a nuisance it is bound to attract the attention of neighbours - in this case I'd say it may be a very good idea to get the Council involved.

Not just to curb the problems caused by the nasty smoke but to check on the well being of this gentleman and offer some assistance if needed.
