recently split with partner i was the sole breadwinner in the house, i bought and paid for all bills , mortgage food - everything, I also bought a dog, since we split shes kep the dog , can i lawfully remove it i also bought her a horse, she can keep it , but i suggest its fair if she keeps that , and i the dog, horse is worth around 2k she tried to frame me for assault, but cps are looking into her controlling and coercive behaviour.

Who is in the best position to look after the dog and by that I mean be home in the daytime so it is not left on its own? Do you want the dog because you love it or because you don't want her to have it?
Without hearing your ex's side of things, it's impssible to be certain how a civil court would rule if asked to decide who owns the animal. (For example your ex might say that you gave her the dog as an unconditional gift; you'd then have no right to demand its return if the court believed her account).

However if you genuinely believe that the dog is yours (because you paid for it and you didn't transfer title to it by gifting it to your ex) you can take the dog without fear of being prosecuted for theft. 'Theft', as defined by the Theft Act 1968, has to involve 'dishonesty'. and Section 2 (1) of that Act states:
"A person’s appropriation of property belonging to another is not to be regarded as dishonest . . . if he appropriates the property in the belief that he has in law the right to deprive the other of it . . . "

we dont know who owns the dog and a civil court will not really entertain a case only about a dog ( like the judge will swear (not you) and throw the furniture around at the hearing to have his time wasted with things like this.

discuss it with Madame and get agreement - horse for dog seems fair but then you have to look after it - (no no dont tell us you have already bought a little doggy....)

i love the dog more than my ex, chihuahua, who couldnt love her?? , but ex mrs will sell her out of spite im reasonable she isnt

given that she tried to frame me for assault and police are investigating for coercive behaviour , - her agreement or assisting with anying is zero, in fact if she knows i want it shell deliberately move it , these people are known as psycoppaths
