Teen Smow has decided he wants to move back home and he has already had an interview and been offered a job for 10k more than he is getting Now. He has spoken to his current bosses but they say he can’t just give a months notice, as you apparently can’t give notice mid month, and so he cannot leave till 31st July. Yet he knows that his main manager is off for last two weeks of July and that’s why - they want him to cover that. Any suggestions, as new job is asking when he can start!

If that was me smow, I'd tell my boss I couldn't do it as I want to start at the new job soonest.
They are telling him porkies. He can give his notice at any time.

That’s what I thought, he just doesn’t want a bad reference.
He needs to check what it says in his t and c's ....does it say "month" or "calendar month" Personally I think they are trying it on. He could also get advice from his union or acas
If hes already been offered new job then bad reference will not be an issue. He needs to read his contract of employment about giving notice to leave. Its his current employer that have problem. What would happen if he was ill when his boss was on leave?

He’s on way into work now to check his contract but he does know that the main manager yesterday said to him”If I’d have known why you wanted to see a copy of your contract then I’d never have agreed to send you a copy “

Surely he'd have been given a copy of his contract when he signed it?
He should have his own copy, hopefully he signed contract. Otherwise it my be "modified" to suit his current employers needs.

I'm pretty sure it would violate some legalities or at least some morals if they gave him a bad statement because he refused to be forced into working for another two weeks simply because they are short staffed.

When i worked for a call centre for the short space of 2 months, my contract was kept on a computer, when i signed it, it was via a touch pad. The contract was always kept in an online system which i could access via credentials.
He should have his own copy. If his current employer will not show him copy. Maybe one of his co employees has theirs that he could look at, contracts will be generic.
Alternatively just hand his notice in tomorrow giving a months notice and give new employers a start date.

Yes he knows exactly where his contract is online- he just needs to get into the office to check it.
Does he have any accrued holidays he could take during his notice period?
There could be the makings of another unravelling saga here.

Hand notice, any drama down the line go off on the sick with stress or whatever.

I don't think you can give a bad reference any more, doesn't it just have to be limited to the dates you worked there, in what position and possibly include the salary without any mention of performance or personal attributes?
Could he not wait until end of July to leave the job he is in at the moment ?

He’s got about 5 days hols left. Would be bad to give a bad reference seeing as he won Employee of the Year out,of the entire company last year lol
