I have been following this story since reading a detailed account of the circumstances which resulted in her murder conviction.

Well done to her sons for following this through and getting a 'good' result so far.

A very expensive retrial will probably return the same result. She caved her husband’s head in with a hammer. A divorce would have been less messy and cheaper forthe taxpayer.

To be fair there does not appear to be any doubt that she killed her husband.
Poor lady. I too hope things turn out well for her and she finds some peace of mind.
The use of the word "quashed" is quite descriptive.

I very much doubt that the retrial will result in a murder conviction. Yes, she did smash his head in with a hammer but she was driven to distraction by his abhorrent behaviour.

Are we allowed to discuss this on here? Just asking in case I have made a bit of a blunder, in light of the fact that this is ongoing.
// A very expensive retrial will probably return the same result. //

erm if the judges are so wise that they think the same thing will happen all over again - they wont order a retrial

her lawyers persuaded the appeal court that the defence has not advanced the defence of mind control well enough

'her lawyers persuaded the appeal court that the defence has not advanced the defence of mind control well enough'

Peter, what does that mean?
Which two mental conditions is she supposed to have?
From what I have read about this case the husband was a vile bully who abused her constantly for 40 years and she finally cracked when she discovered yet again he was being unfaithful....he put her down so constantly for so long she was no longer her. The fact her sons are on her side is very telling. I do hope the coersive control aspect of this case allows her to go free.
I don't know enough about the case but if any evidence that should have been presented at the time wasn't, then I hope the right decision is made.
A man was killed in a very violent and grusome attack. It went to Court and the attacker was convicted.
Even if the victim was allegedly abusive, it is no excuse for his horrible death. A divorce would have cost her £400.
From what I've read there some pertinent evidence not presented at 1st trial, so appeal judges have ordered a retrial.
Ok Gromit, don't think anybody is denying that she killed her husband, but was it murder?
Question Author
Challen's solicitor and co-founder of Justice for Women Harriet Wistrich, said: "We are not arguing in this case that coercive control would provide a complete defence to murder, but the circumstances of a lifelong marriage amount to a form of provocation, which should reduce a murder conviction to manslaughter."
A very expensive retrial will probably return the same result.

Lucky for her you won’t be on the jury nor in charge of the justice purse strings.
//Even if the victim was allegedly abusive, it is no excuse for his horrible death. //

Absolutely, but retrials aren't easily ordered without good reason. The appeal judges have obviously felt that key facts weren't considered which ought to be.

The same verdict may be returned but if the new evidence is cogent then it makes all the difference.

Who was it that asked if it was time to bring back capital punishment? Hmmm.
Mental torture is an awful thing and its easy to say walk away when you are not in that position. While I would never say its was ok that she killed him I understand her pain and despair at her situation.
I doubt many of her AB fans would be so supportive of a hen-pecked husband who battered his wife to death with a hammer.
Well Helen was found not guilty of attempted murder of Rob Titchener in The Archers, so there is hope for her.
