Returning to work after sickness

I was signed off sick with stress 4 weeks ago. I now feel that I would like to return to work to be able to work through the problems that originally made me ill. My doctor is in agreement with me although he has suggested part time work to begin with. However, my OH department, after just one meeting with them, has said that I am still not fit to return to work. I have agreed to undergo counselling etc to help deal with the problems but still feel that I need to be allowed to work at the same time. Can my OH department stop me from working even though my doctor says that I am fit to return?

If your employer believes that your stress is work related, it will be difficult for them to allow you to return to work if they have reason to believe you are not fully fit.

They have to protect you from further stress, and be sure you will not be claiming for compensation. It is a real worry for bosses these days.

Also, your employer has a duty of care to all the employees. If your illness is such that your colleagues could be affected then he is doing the right thing.
