Encrochat was perfectly legal and a legitimate business in its self.
The NCA illegally broke into it, launched Malware and made thousands of handsets into £3000 bricks.
The Lawyers could argue the evidence gathered was obtained illegally, and is therefore inadmissible.

Bet that Dick knew naff all about it until it was over or they would have still been hand wringing, consulting with you man rites "experts", and worrying in case there was a black face involved. yup there was a sentence on this in the original report which was later taken out. Lawyers already whingeing. see the Wire - putting a device inside a phone needs a warrant but selling a device already wired - doesnt.
This was the basis of the weeping Angel program - so do you watch Samsung or does it watch you ? - the crims buy a machine already bugged and so all that needed is to turn it on and ya dont need a warrant
