Of course the real question here is Does a man have the fundamental right to sleep with his wife if she doesn't have the mental capacity to consent? Followed by, if not how can the law prevent it happening?

well he didn't go through all that schooling in life to make one silly comment and lose his job. Maybe it should be reviewed but i mean.. I's not that savage to be fired over

Yes, that is the right of every married man to have sex with his wife, but not so necessarily in non marital situations.
If this is not afforded to the man, then he has every right to seek sex elsewhere, that is if sex is important to him.

Yes i agree tilly. However the judge isn't saying the man should be able to sleep with his wife without consent, he's saying the fact she can't give consent should be further analysed. Because, IF she could give consent, and did, then the man slept with his wife, he'd be arrested because the court said she couldn't.

It's my view that instead of making a generalised comment he should have concentrated on the finer points of the very particular case in front of him.
It used to be the case that if a man didn't have intercourse with his wife she could divorce him for non-consumation.

Tilly....of course you have rights, it depends upon how many times that you say no, as each time may push him further away from your arms...........or it my not. It is based on individuals need and requirements....by that i mean the man's..;0)
Of course every woman has a fundamental right to refuse to have sex with anyone, including partners. And the judge was, perhaps, a tad foolish to express his decision in such a way. But surely it is not for social services to determine whether or not the wife has the mental faculties to choose whether or not she wishes to sleep with her husband. Isn't that something doctors should determine?

Other countries deal with the problem by the men having mistresses....e.g France, Greece, Italy...widely accepted as a solution to the problem
In the UK we have seen the explosion (sorry) of Escort Agencies and prostitution, not to mention the rate of extramarital dalliances.
if the man or woman was suffering from senile dementia or any type of disease where they are not always compos mentis would they be allowed to have consensual sex ?
