no mot?

I was stopped yesterday for speending and recieved 3 points and a fine, but when i got my documents together iv noticed my mot had expired a week before i was stopped, Although the policeman that had stopped me didnt mention it. If i get it mot'd before i go to the station to produce my document will i get away with it or will i be fined? this is my first offence?

dont quote me on this but no. its at the arresting officers discression if he charges you with it sounds like he got u for speeding but didnt want to completely ruine your licence
The whole point of 'producing' is to see if you are driving legally. You are liable to prosecution for having no MOT , which will also invalidate your insurance. Having said that, get the car MOTed and take both certificates. Don't try and pull the wool over their eyes, but say it was an honest mistake. The old certificate will show you were only a week out, which will be in your favour, but you still may get fined. Just depends on the desk clerk/officer. In future, write on your calendar or diary a note to remind you when your MOT is due.

But i would just get a fine for no mot not insurance right?
Not necessarily. As I said, if you have no MOT, this nearly always invalidates the insurance as well (read your policy). It really is at the discretion of the officer. Personally, I think you would be hard done by to be done for either or both, but its not me who is charging you.
Having no MOT does not, I repeat DOES NOT, invalidate your insurance unless you are involved i nan accident, and a component that would have been picked up on the MOT (and would cause a fail) was the cause of the accident - IE a wheel coming off due to suspension issues, or a tyre blowing out due to it being down to the canvas.

I don't know why everyone thinks it invalidates your insurance.

We only check if you have an MOT if your car is stolen, or is a write-off. Even if it doesn't, most insurers will reduce the value of the settlement, but even the Ombudsman won't allow this if the policyholder challenges this.

I'm not sure what (if any) punishment there is for no MOT - someone like Ethel or New Judge would be able to put you straight

Well I stand corrected gouldc. I always thought it did, but by your phrasing I assume you are something to do with insurance, so should know. Sorry for any misinformation.

Yes, I do work in claims, and whilst I don;t know everything, total loss and theft claims are my speciality
