is it against the law to smoke while driving and would a driver get an on the spot penalty if caught ?

However, the fact the driver was smoking could contribute to a charge of driving with undue care and attention or careless driving.

thank you Ethel. my daughter was arguing with me that you could. i do watch the news every night and read the papers and i didnt hear about it. she actually had me stopped smoking while i was driving !! i think i will still stop smoking while driving.... now i know i can do it. Lol thanks again.
can i just say before i go....i have learned alot from the answers you give on here. thank you.
A little point of pedantry on my part.

The possible charge would be "without due care and attention" etc.

Care and attention when driving is never undue.
Ethel's answer only applies to the private motorist. An employed person driving a company vehicle cannot smokewhilst driving or whilst in the vehicle.
