I got zapped the other day in the works van i was doing 35 in a 30 (YES HONESTLY) at 650am (half asleep)

Obviously the ticket wont come to me because im not the registered keeper so is there a grey area where i could maybe 'get off' with it'?

or is there perhaps a chance there will be no ticket at all due to the borderline speed and time of day do the speed camera authorities use any discretion?

sometimes there's not even film in the cameras. And sometimes they don't bother with speeds which aren't much above the limit - it depends on who's doing the enforcing. So yes, you might be lucky. I'd suggest you don't offer 'I was half-asleep' as an excuse, though.
Firstly, if a ticket is issued it will go to your Company who will no doubt be fully aware as to whom was driving that vehicle on that day.

On the positive side many cameras are set to just flash but don't actually have a camera installed, so you might be lucky - time will tell.

i hope so my bosses are pretty easy going so might pull the ''we dont know who was driving that van that day'' card

so would be difficult to prosecute id think

I hope it did not have a film in a lot of them dont. If it is your first speeding offence they will probably offer you the choice of paying to go on a speeding awareness course this way you don't get any points.As for your firm saying they dont know who was driving it does not work any more they just fine them.
as for your boss saying.we dont know who was driving that day, that does not work anymore,so i doubt he will say that.
If your boss says he doesn't know who was driving, he will be prosecuted under s.172 RTA - or rather the company will get a hefty fine.

Time of day is irrelevant.
It's not all bad news!! One might not be coming - that's down to the settings of the camera. Most are digital nowadays, so the old film rule generally no longer applies, but many are dummy boxes anyway.

If a NIP (Notice of Intended Prosecution) is sent, they have only 14 days for it to be sent to the registered keeper or nothing can proceed. They also only have 6 months from the date of the "offence" to inform the magistrate they would like to prosecute the driver (NOTE this is not the date the driver is summonsed which can be some time after).

One key thing is that you (and indeed everyone who receives any correspondence) has 28 days to respond to each letter, so use ALL of them EVERY time - well 26 days at least to make sure you don't get prosecuted for non-response!

If the van is leased that's even better, as it adds another level to help drag out the time to take it past the 6 months.
Either way speak to whoever handles the vehicles for your company as they will sooner or later get that piece of paper and get them to delay response until the 26th day.

If there were two of you in the vehicle and it could have been either of you driving get your work to give them the details of the other person (after 26 days!) who in-turn will then give them your information (after another 26 days).

Asking them to prove who was driving doesn't work for rear-facing cameras and also doesn't delay anything so not worth pursuing unless you are truly unsure.

Best bit of advice is join PePiPoo (www.pepipoo.com) for fantastic advice. They saved me from any points or fine for being caught by a mobile camera doing 81 in a 70 on a dual carriage-way (just where you want the cameras - but none where kids play??!!)

Why should you get of with it.

You was the one ''speeding'', and if you were still half asleep thats even more alarming.

The ticket will come back to you eventually, and hopefully so will your P45.

Often it depends on the enforcment borough....

I know chelsea used to be tough, but i think they are not as tough as they used to be....

Rather the metropolitan excuse me......

It really does depend on who gets a look at your picture or not.....
i've probably been flashed 10 times over the years and had nothing so it's luck of the draw on the camera.

The old "I don't know who was driving" won't wash lol
10 times rever.

Please point out where I was boasting about speeding. Ive been flashed 10 times ish over 20 years thats once every 2 years.

I suspect anyone on here with an ounce of sense would conclued that you speed quite frequenly in between the cameras.

You broke the law, and hopefully your job will see fit to get rid of you, you think that by driving a works van gives you licence to do what you do you idiot.
