No

The law does not apply to:

a driver who is 17 years old if they are on their own in the car

Thanks. What if there was an adult in the car?
It is illegal to smoke in a car with anyone under the age of 18 - so an adult passenger in your scenario doesn't count.
If the adult passenger is smoking he is breaking the law if the driver or anyone else in the car is under 18

Thank you HC.
If anyone (whether 17yr old or older) was driving on their own and smoking, it looks like they would not be breaking the law in relation to smoking in vehicles (unless perhaps if it was a works vehicle?)
If they are holding a cigarette though while driving could that be treated in the some way as drinking coffee, eating an apple etc for which some have been prosecuted
17 year olds aren't allowed to buy cigarettes, though.
It seems wrong to me that smoking while driving hasn't been totally banned.
It's not illegal for 17 year olds to smoke, in fact it is not illegal for any child to smoke.
has the 17 year old got a full driving licence?
Hells Bells, Cloverjo! I’ve never heard about a crash being caused because the driver was having a drag on his cigarette. :-0
Many accidents have been caused by distracted drivers fumbling to light their fags or picking up dropped cigarettes.

It depends on what he/she is smoking :-)
A lit cigarette in your lap causes panic

I can't believe that my simple question has now got people driving without a licence and taking drugs at the same time! What's going on ?
Or scratching their leg, or turning the radio on, or sneezing, coughing, burping, hc4361.
Smoking while driving is definitely illegal, and it applies to all no matter what the age of the person is. A 17 year old kid, first of all needs to have license in order to drive the car. Nowadays, people have switched on to buy weed, in order to smoke, and this increasing use is because of some of the benefits that weed offers. I started smoking weed, because I came to know that they are less harmful than tobacco, so I thought this would be the perfect way to achieve some pleasure without causing much damage to myself.
