Fog Lights in MOT

If a car has fog lights but they don`t work will it pass an MOT? My sister-in-law`s car failed because of it and she had been told it would pass.

Vehicles first used on or after 1st April 1980 require one rear fog lamp to be fitted to the centre or offside of the vehicle.

This mandatory fog light is part of the MOT inspection but any other fog lights are optional and do not require testing.

I'm sure there is something in the MOT test that says something like "if a light is fitted it should work"

I might be wrong though!
