If you read deep into the story it does say "A spokesman for Avon and Somerset Police said 'Under the Sexual Offences Act 2003, it is not an offence for a person to appear naked in public.

'But it becomes an offence if it can be proved that the person stripped off with the intention to cause distress, alarm or outrage.' "

But Surrey Police said 'If you want to wander around your garden naked and you are overlooked neighbours then you have to be careful - an Englishman's home is not quite his castle and your garden is not exempt from the law.

So which is it since if your sunbathing then you are not trying to cause offence and if you are waving your tackle about then you are clearly not sunbathing?

Be extra careful if you're strimming or pruning.

If your neighbour is a prim old lady then I imagine she might be shocked at the sight of a naked body.

But then you never know Danny, tell her and she's reaching for the bino's before you get to your back gate!

I somehow think there would be a stampede for a refund if they saw me :-)

i'll watch out for the strimmer, thanks for the tip.
Wear protective goggles if operating machinery !!
I was so shocked and disgusted to see our neighbour sunbathing naked that I nearly fell off my stepladder and dropped my binoculars.
It won't be the first time that a neighbour has seen their neighbour's pussy in the garden.
LOL, at Arrods & AOG !
i always keep my safety boots on, am i safe from prosecution?
Someone may be shocked, but it might not have been the intent.

One might need to wave one's tackle about to give it a good airing and an all over even tan.

I suspect the A&S are correct, but that forces will react as per Surrey anyway. You demonstrate in court that it was wrongful arrest.
Consideration should be shown to frail and elderly neighbours at such times. Remember that the use of step ladders at an advanced age may be hazardous so always make sure you are easily seen :-)
Thankfully, my neighbours would need a light aircraft to see into this garden. Although the glare from the exposed white bits could be dangerous.
I like to give the neighbours a treat now and then.....
