Hi all, had a shunt 2 weeks ago now, of which not my fault as I was stationary, guy ran into me, therefore he is liable, however my insurance keep saying they are unable to get any response from him via letter or telephone call, I have all his details and he has not reported the incident to his insurers either....what can I do...I feel my insurance company are not doing much to move things along as I am eager to get my car repaired....

Do you have legal cover with your insurance? I had an idiot in an army truck hit me on the A303 once. We exchanged details and I filed my report with my insurance company. He didn`t bother. My insurance company put their solicitors onto him and that scared him into action.

Im fully comprehensive...not sure if i have leagal cover...I think so...
You need to check your schedule and see if you have it. I was with Direct Line at the time and I must admit, they were quite good.

Well Purple, I`m not an expert but I filed my report as you are supposed to do. There were no witnesses because the only witness was the other guy in the army truck and he didn`t count. The insurance company didn`t make me wait to get the car repaired. The plan was to repair it at my insurance company`s cost, then they would reclaim their costs from the army guy`s insurance. As I said, the guy didn`t bother and Direct Line put their solicitors onto him. I think it was quite a few months later before he buckled under the pressure (probably because he was driving an army vehicle and it could have impacted on his career) I would phone the claims people and tell them that you are paying for legal cover and they should stop procrastinating. I have a good witness and everything....100% his fault....its only scrapes and scuffs on my vehicle but its unsightly and i want it repaired asap, my insurers said I would have to have it repaired by making a claim, but as its a non-fault accident I would have to wait for liability....I dont want this to affect my NCD....
As you are comprehensive the fact that the third party hasn't responded yet is irrelevant as far as getting your car repaired is concerned.

These are two entirely separate issues.
why is your insurance company not just dealing with his insurance company? they're the liable party.

The repairers phoned me today, I can get my car booked in for repair but I would need to pay the excess of which I would eventually receive back - but getting this back could take months.
If the other guy hasn't reported it to his insurance company then your insurers should be taking action against him personally. Did he not give you insurance details when you exchanged information? Your claim is, in the first instance, against your own policy, and then your insurance company claim off the other guy to recoup their losses. There should be no shilly-shallying.
