If you have been separated for 3 years but not divorced, can a spouse claim any money you have when you die?

Without a divorce, she's still the next of kin. If there was no will then she would inherit.

Inheritance laws are different in the constituent parts of the UK. In Scotland a child or spouse who is not a beneficiary of the will can still exercise their legal rights in order to benefit from an estate.

This isn't the case in England & Wales, although dependents can make a claim against an estate and pension death benefits are paid to a spouse.
