Leak from upstairs flat

My fiance and I live in a ground floor flat. We have a person living above us. For the past year, a leak has been evident coming from the upstairs flat and manifesting itself as a stain on our bathroom ceiling. We claimed on our building insurance, as did the person upstairs to a- repair the leak and b-repair our ceiling. It then happened again, this time a hole appeared in our ceiling! We again both claimed and again, both had our repairs done. Now, six months later, the leak (plus stain) is back! Now it is a more or less consant drip. We are now a little bit annoyed with the whole thing. Although our neighbour is sympathetic to a degree and has attempted to have the leak fixed, clearly, it is not fixed and as a result, our ceiling will soon need to be repaired again (if not right now). Legally, where do we stand? What can we do to get our neighbour to actually get this leak tracked down and sorted once and for all. Do we have any legal basis to move forward from or is it just a case of continuing to claim?
