I recently had a serious complaint made against me by a client. The client accused me of carrying out an act of dishonesty. This has now been investigated and I was interviewed by my employers, and the claim was found to be without foundation.

Unhappy with this outcome, the client continues to make unsubstantiated allegations to other clients - damaging my reputation and undermining my standing with my employers and other clients. I believe that I have a case for sueing for slander - but hopefully just the threat would be enough to silence the client. My employer will not give me written evidence of the complaint against me. What can I do to get a copy of this info? My employer is private sector so I don't think the FOI act applies, and I do not know how the info is stored so not sure if the Data Protection Act will apply? Advice gratefuly received, thanks

you could always try going for slander, but you would have to prove some sort of damage. perhaps next time a complaint is made get a friend involved as at least that will proviide some hearsay evidence.

you possibily could try claim malicious falsehood, if you could get hold of any paperwork/email. perhaps try and find some other way of getting the material; asking to see the complain yourself as you dont understand their allegations and would like to improve your service etc. legal aid is available for malicious falsehood so make any notice to the alleged tortfeasor a bit more potent

To Nhozu since you seem to have some grasp of the law.. can you explain to me what Malicious Falsehood is?

I may need to use that angle myself for some slanderous statements made against me....

Thanks
