My partner was divorced 4yrs ago,and stayed with her 3 children in the marital home,by agreement, lasting until the youngest child became 18.Since then she has paid the mortgage and bills, her ex does not pay any child maintenance. The house is now in a dangerously dilapidated state, and she desperately wants to sell and move on,as she cannot afford the money to do the extensive repairs necessary. Her husband is refusing to permit the sale.Is there anything she can do?

i wouldnt have thought he had a say in the matter as he isnt living in the marital home anymore..and she has paid the mortgage and bills..would be a good idea to have a chat with the citizens advice bureau just to make sure...
He does have a say because he is a legal owner.

She can apply to the court for an Order for Division and Sale. The courts very rarely refuse, and when they do it is because there are very special reasons such as it has been extensively adapted to account for a disability
