I have a mobile phone contract which gives me my cash back in three instalments of �140. I have had one payment already. The second was due in early August, but they keep telling me I will get it in 7 days. The third has been denied because they claimed that the paper work was not complete. This is not true, as I double checked everything and saved a copy of the paper work that I sent in. My partner is having the same problem with her account, even down to the fact that they claimed that her paper work was incomplete. Its obviously a scam they are trying to work. I am about to issue them with court proceedings to reclaim the second cash back. Does anyone know if I would be allowed to claim the 3rd cash back amount from them on the same court order?

as long as the third payment is past its due date, you can claim back for both on the same order, but not until its on or past the due date though because they still might pay it., hope this helps

I sent the 3rd claim in on 24th August, and they say it takes up to 45 days to make the payment. The problem is that they have denied the claim for the 3rd payment, claiming the paper work was not complete. I want to claim this 3rd payment of 140.00 as I know that the paper work was all correct. As previously mentioned, they have said exactly the same to my partner when she claimed the 3rd payment.
my suggestion is for you to write to the company and get them to send written proof that they will not fulfill their part of the agreement, in your letter to them advise them that you will be taking the matter to the small claims court. we don't understand how they can say that your paperwork was incorrect and still have paid you the first months refund,. you need to get them to tell you what was wrong with your paper work for them to deny paying any further refunds.,
Cash back is biggest rip off ever. Say you will go to Trading Standards if it isn't paid within 7 days. They rely on you giving up so fight on!

They rely on you missing the deadline for claiming your cash back. I know for certain that all the paper work for both mine and my partners were complete. Its simply a case of sending in the first 6 phone bills, along with the claims voucher, then the next 3 phone bills and the voucher, and finally the last 3 phone bills and voucher. They paid both of us the first cash back. They are now over 6 weeks late paying the 2nd cash back. We have both telephoned them and e mailed them asking for the money to be paid, and every time they make promises they do not keep. Finally, they said that both sets of paper work (3 phone bills and a voucher) were incomplete. I now know its a scam they are trying to work on me, and many others. I have proof that they are in breach of their own T&Cs by not paying on time. I was just wondering if its worth pursuing the third payment through the court, as they are claiming it was incomplete.I have already told them I am starting court proceedings against them, but all I got was an e mail informing me that the paper work for the 3rd claim was incomplete
have you been in touch with your provider (orange, o2 etc...), to advise them whats happening. they may be able to give you more suggestions. is all your correspondance with them by e-mail? is there not a team leader /supervisor who you could speak to? don't give up the battle tho'. take it all the way if you have enough proof that they have breached their contract to you.

I have spoken to the team leader by phone, only to get the same reply as the e mails. It seems like they are just sending out the same e mails to everyone, as well as giving the same excuse on the phone. The 3rd cash back paper work consists of 3 phone bills and the cash back voucher. How can anyone make an error in sending these four items?. It would be obvious to anyone that they had sent only 3 bills and no voucher, or 2 bills and the voucher. When you speak to them on the phone they are like robots, simply reading their replies from a card. They just don't listen when you tell them that all the paperwork was correct. I am certainly taking them to the small claims court now. I am sick of their attitude. The total owed on both our contracts is �560.00 (�280.00 each) Let this be a warning to anyone thinking of getting a cash back phone contract. DO NOT GO WITH MOBILE RAINBOW !!!
