conditions of direct debit

o2 have taken 100 quid out of my account by mistake and wont refund it for 28 days - my bank says that there are conditions that state an incorrect debit must be refunded immediatley - i cannot find anything an the internet that can prove this when i call o2 tomorrow - can anyone help?

i had same problem with 02 told them that if i go over drawn they will be taken to court,PIFF PAFF POOF my money was back,also told them ill cancell mine and the girlfriends account like they say read the aggrement
According to the direct debit guarantee, if an error is made when collecting a direct debit, you are entitled to an immediate refund - from your bank, who must then claim it back from O2 (or whoever).

thanks both, at least now ive got something certain to say when i call tomorrow - so its my bank i need to contact then not o2
watch out with O2, they have doen it to 3 people i know including myself. They refused to give payment back but credited the statement the following month. Because i had cancelled the DD and sent them the correct figure (taking over payment out) i was then deemed as being in arrears every month and every month when they sent the statement i was cut off the very same day. Each month taking 3 days to reconnect. I was pregnant at the time and need my phone when travelling so i was not best pleased. it took 6 months to sort out the problem and they even tried to take it through the courts.

I got out of my contract in the end, luckily.
