A colleague at work has been stealing my pens for the last couple of weeks now. I have already approached him about his 'problem' and also asked for my pens back. He replied something along the lines of "no, they're mine now" and that was the end of that.
(I have just noticed the pen I was using only a few mins ago, appears to have suddenly gone "missing"...)

My question is, what legal action can I take against this colleague/ thief at work, so I can get my pens back?

If you're talking about family heirloom pens, feathers that were used by Shakespeare etc, call the cops. If you're talking about Bics, skip it - but keep an eye on the ones you still have and don't be afraid to announce in a LOUD voice that you'd like them back if he picks one up.
try the small claims court you have been robbed
leave a pen on your desk but put super glue on end where you hold it, when he picks it to take and then use it the pen will become permanently stuck to his fingers.

Assuming you're using the office's stationery supply, then, of course, the pens are your employer's property so a colleague cannot steal them from you. However, my tip is to give your pens a good suck and a chew: I have found that this deters any would-be pen thieves.
Or go the local stationary shop and buy 4 boxes of 20 pens (should cost �10 or so) and then before get's in put all the pens on his desk (not in the boxes of course empty them out in the most annoying fashion).

but on the off chance that you are being even remotely serious - covering them in coloured stickers is the way forward...

you, the pens and a large packet of stickers featuring girly things like teddy bears, hearts, pink, etc etc, are all you need to turn your life around and get over this trauma.

Buy one of those joke pens where it gives you a shock when you try and click the top!
We were in a similar situation with a post-it note thief a while back, so I can empathise with your plight. It was impossible to reason with her and we eventually had to break into her drawer while she was on holiday to retrieve the stolen items. I wouldn't advise going down this route though, she was livid. You could perhaps try attaching small bells to the end of your pens to alert you as the crime is being committed, wear them around your neck, or lock them in the petty cash tin when you're away from your desk. Let us know how you get on.

If you speak to the Police then they will obtain a warrant and escort you into the premesis to search the offender. Once they have found the stolen items the theif will be arrested and dragged off to jail. They will have a criminal record, probably never get a job again, turn to a life of crime. They will mug old grannies for their bus fare, hang out around school gates to bully children an die fom an overdose before their 40th birthday. This type of problem needs to be addressed NOW before it gets out of hand.
Get one of those pens attached to a chain/cord that they have in banks attach that to your desk and bobs your uncle!!

Just make sure you have enough slack on the cord so you can write properly but not enough so to allow him to use it from his desk.
Keep your pen in your pocket perhaps...
