that regularly comes into my garden to do its business and kill the birds, would I be in trouble with the law. The owner doesn't care.

yeah you are right, pixie sorry....it wasn't you who posted the "cats are like caged eagles" carp.
Maybe not woof, but they all need to go for walks and get out in the fresh air and be given the chance to socialise.
I am pretty sure you have a pass so long as the dog is secured in the property
The homeowner ( cat's owner?) doesnt care

so when the cat comes in thro whatever - you cant have photoelectric activated slats to prevent escape
or an automatic net that scoops it up and dangles it at muzzle level of the dog ...
or a humane kittie paw stopper so the cat cant move as the dog hoves into view

A small dog wandered into our garden. The cat soon saw it off! Neither animal was injured but the dog was quite obviously embarrassed.
I very often get visited by stray or wandering neighbour cats. I humanely trap them, take them to the vet for the snip(m a d f), the female has an ear "nicked" and then release them so they can go home
Here if an animal trespasses we can take them to the pound, keep them or neuter them. Doesn't matter if they are microchipped they are trespassers

I watch Judge Judy all the time and this subject comes up regularly. You have your dog on your property and if cat comes in, the onus is on the cat. Anyway all the cats that live round here are extremely energetic and great climbers so do think the cat/cats would be ok.

Most do but not all, as I said, some dogs don't like other dogs, some are fearful of them. I know a dog trainer and behaviourist who has got 5 dogs of her own. All but one are rescues. Some like walks, some definitely do not, some are happy to travel in her car, others are not. She works with whatever makes them happy. I don't think that its sensible to say "all dogs" anymore than it is to say "all people"
I'm in Portugal. Vet gives me a discount as I work with a registered charity. We are in contact with all local councils and their vets and fund raise for a Spey, neuter and release programme. We also arrange this for low income families for whatever they can give. Eggs and veggies and fruit often enter the equation!. We also accept animals for rehoming. We do Spey pregnant females if they are street animals or if the families ask.
We are SOS Animals Algarve. Sterilise our Strays if interested
