Fly Tipping

Opposite where I live is a bakery. At the moment during lockdown they are extending their staff parking and van turning area. The dug out soil has been out in the field which is their land. They have also moved some empty pallets there as well. My question is it illegal for them to do this or is it classed as fly tipping.
A resident of a property that over looks the field is kicking up a stink about it saying they are fly tipping .
Honestly their field is huge and I can’t see what the problem is.
The resident bought the house knowing it overlooked the bakery which is running 24hrs a day 6 days a week

If they own the land it can't be fly tipping.

That’s what I thought
But if it's perceived that they are using the field for a commercial purpose and they don't have planning permission to use it for that purpose, they may fall foul of the planning regulations.
