Boundary Issue With New House

Hi all, hoping that somebody can help as asking on behalf of a friend. They have basically reserved a plot on a new-build small estate. He was due to complete in the next couple of weeks but very recently noticed that the land registry site plan does not match with where the fance that has been put up on one side of his already small garden; essentially losing about 8sq ft of his garden. This is because the land is being used as part of the showroom/house and sales office. They house builder has said they will move the fence back when the show home is sold, which could be the spring/summer next year. My friend wants to move in and landscape his garden, which he can’t do until the fence is moved.

Is my friend entitled to any compensation for this loss of his land for what may be almost a year?

I would suggest that your friend should immediately talk to his/her conveyancing solicitor about this.

His conveyancing solicitor should have investigated this at the outset.

Promise made by housing companies are rarely kept once they're off site. They should refuse to complete until the fence is moved. If moved after the show home is sold it might also cause friction with his new neighbours who expected a bigger garden than they got!

In my opinion, such a case should be investigated with a lawyer. I can't tell you exactly what to do because I am not a lawyer. When my wife and I were buying a new piece of land for living, we had similar problems, but the seller, as a result, moved everything as needed so as not to create a conflict.
