Someone I know is only getting 25 paid days a year holiday. They are not receiving 3 bank holiday days as the business owner has told them she can't afford to pay her the legal statutory amount. She is obviously (and knowingly) breaking the law, but the girl and the other members of staff who are also not getting what they should be are afraid of taking this further in case they lose their jobs. Any ideas what can be done?

AS she doesn't want to approcah her employer about it right now, I would advsie her to speak to ACAS for advice about how to take it forward.

Assuming the employees work full time then I'd be tempted to call the employer's bluff on this. If the business really cannot afford to comply then it may be that' it's not a viable business and may have to eithe restructure/cut hours, reduce pay rates or find some otehr savings- or look for new markets. It would be a pyric victory though if the employer makes the extra holiday payments but reduces your hours by say 1 hour a week or cuts your pay by 1-2% to pay for it.

try ACAS and also find out if he is protected in anyway

Has the employer set up a pension plan for the employees as required by law? Would imagine that is also unlikely in this case.
